1. Scope

These Terms and Conditions apply to all orders placed through the Fravantis online store between us and our customers.

These Terms apply to both consumers and business customers, unless otherwise specified below.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. A business customer is a natural or legal person or a partnership with legal capacity acting in the exercise of their commercial or independent professional activity.

2. Subject of the contract

The Fravantis online store offers physical posters and art prints in particular.

The essential characteristics of the products can be found in the respective product description in the online store.

Product images serve to illustrate the products offered. Depending on the screen used and its settings, colors in particular may differ slightly from the actual appearance of the product.

3. Conclusion of the contract

The presentation of products in the online store does not constitute a legally binding offer, but an invitation to place an order.

The customer can select the desired products and place them in the shopping cart. Before submitting the order, the customer can review their details and correct input errors.

By clicking the final order button, the customer places a binding order for the goods contained in the shopping cart.

The purchase contract is concluded when Fravantis expressly accepts the customer's order or dispatches the goods, unless the specific ordering process or the payment method used indicates otherwise.

Receipt of the order is confirmed to the customer electronically.

4. Prices and shipping costs

All prices stated in the online store are total prices in euros and include any applicable statutory taxes, where levied.

Shipping costs may apply in addition to the stated product price. The amount of the shipping costs is displayed to the customer before the order is completed.

5. Payment

The customer may use the payment methods displayed during the respective ordering process.

Payment is processed according to the payment method chosen by the customer.

Unless otherwise stated for the respective payment method, the purchase price is due upon conclusion of the contract.

When using external payment service providers, their terms and privacy policies may additionally apply.

6. Delivery

Delivery is made to the delivery address provided by the customer during the ordering process.

The expected delivery times are stated in the online store or during the ordering process.

If an ordered product is exceptionally unavailable, the customer will be informed. Payments already made for undeliverable goods will be refunded.

The customer is responsible for providing a complete and correct delivery address during the ordering process.

7. Retention of title

The delivered goods remain the property of Oliver Hardt / Fravantis until the purchase price has been paid in full.

8. Right of withdrawal

Consumers generally have a statutory right of withdrawal for distance contracts.

Details on the right of withdrawal, the withdrawal period, how to exercise the right of withdrawal and the consequences of withdrawal can be found in the separate withdrawal policy of Fravantis.

Where provided for by law, the right of withdrawal may be excluded for goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

9. Returns

In the event of an effective withdrawal, the statutory provisions and the provisions of the withdrawal policy apply.

Provided the customer has been duly informed, the customer bears the direct costs of returning the goods.

Irrespective of the statutory right of withdrawal, the customer's statutory rights in the event of defective or damaged goods remain unaffected.

10. Warranty and liability for defects

The statutory provisions on liability for defects apply.

If the delivered goods are defective, the customer is entitled to the statutory warranty rights.

Transport damage should be reported to Fravantis as soon as possible so that it can be resolved quickly. The customer's statutory rights are not restricted by a failure to report or a late report.

11. Copyright

The designs, motifs, graphics, photographs and other content offered on Fravantis may be protected by copyright.

The purchase of a poster or art print generally only transfers ownership of the purchased physical product to the customer.

Copyright usage or exploitation rights are not transferred unless expressly agreed.

In particular, any reproduction, digitization, commercial re-use or other use of protected motifs outside the statutory limits is not permitted without the corresponding authorization.

12. Liability

Fravantis is liable without limitation for damages resulting from injury to life, body or health based on an intentional or negligent breach of duty.

For other damages, Fravantis is liable without limitation in cases of intent and gross negligence.

In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract, to the extent permitted by law.

Mandatory statutory liability, in particular under product liability law, remains unaffected.

13. Contract language and contract text

The language available for the conclusion of the contract is German, unless further contract languages are offered in the online store.

The order data and contract information are made available to the customer during the ordering process and in the order confirmation.

The customer can access and save the currently applicable Terms via the online store.

14. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law only applies to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the state of their habitual residence.

15. Final provisions

Should individual provisions of these Terms be or become wholly or partially invalid, the remaining provisions shall remain unaffected.

Invalid provisions shall be replaced by the relevant statutory provisions.
